BERGENFIELD, N.J. -- A Bergenfield ex-con from Trinidad stopped a judge from sentencing him for sexually assaulting a 15-year old girl by asking to his guilty plea withdrawn.
Arthur Gilliam, 37, tried to talk directly to the judge in Hackensack but was cut off.
“At the time I pleaded guilty, I was misrepresented,” he told Presiding Superior Court Judge Susan J. Steele.
“I am always hesitant when defendants speak directly in court,” Steele said, before setting a Feb. 3 hearing on the request.
Assistant Bergen County Prosecutor Kristin DeMarco said a previous judge denied a similar motion by Gilliam.
“It’s the very same issues again,” DeMarco said.
Gilliam has been in the Bergen County Jail since April 2013 and pleaded guilty last October in return for time served and a brief prison sentence.
Had he gone forward with the plea, DeMarco told Daily Voice, he'd likely have been free by now.
Gilliam remains under a deportation order but has said he wants to avoid deportation and return to Trinidad voluntarily.
